2. Description of the Service

3.1. Account Creation and Access

Users must create a personal account with accurate, current, and complete information. Accounts are personal, non-transferable, and protected by login credentials, which users must keep confidential.

3.2. Subscription and Billing

Paid features require a subscription, billed monthly or annually, with automatic renewal unless cancelled before the renewal date. By subscribing, you authorize us to charge your payment method at the applicable rate.

3.3. Free Trial

Free trials are limited to one per user and/or organization. Abuse of free trials (e.g. multiple accounts) may lead to suspension or termination.

3.4. Cancellation and Refund Policy

Subscriptions can be cancelled at any time. Access remains until the end of the current billing period. No prorated refunds are provided.

4. Intellectual Property

All content, data visualizations, software components, and materials available through the Service are the exclusive property of Lancrey-Javal Technologies or its licensors.You are granted a non-exclusive, non-transferable, revocable license to use the Service strictly for personal, non-commercial purposes.

Any commercial exploitation, resale, redistribution, or public dissemination is strictly prohibited.

5. Acceptable Use Policy

Users agree not to:
- Use automated tools (bots, scrapers, crawlers) to extract or replicate data;
- Resell, redistribute, or make available any part of the Service to third parties;
- Circumvent technical restrictions or security measures;
- Launch attacks, attempt to gain unauthorized access, or introduce malware;
- Use the Service for unlawful, fraudulent, or harmful activities.

Violation of this policy may result in immediate suspension or termination of the account, without refund, and possible legal action.

6. Data Processing and Personal Data (GDPR / DPA)

Lancrey-Javal Technologies acts as a data controller for personal data collected when users create and manage their accounts, and as a data processor when handling data on behalf of clients.

We commit to:
- Compliance with GDPR and applicable laws;
- Confidentiality: ensuring authorized personnel only have access to personal data;
- Data Retention & Backups: retaining personal data only as long as necessary for the provision of the Service, with secure backups;
- Data Restitution: upon termination of a subscription, users may request export of their data within 30 days;
- Incident Management: in the event of a data breach or incident affecting personal data, we will notify affected users and authorities in compliance with GDPR timelines;
- Subprocessors: we may rely on trusted cloud and hosting providers for data storage and processing. A list of subprocessors is available upon request.

7. Disclaimer of Warranties and Limitation of Liability

Lancrey-Javal Technologies provides the Service on a “best efforts” basis. While we strive to ensure availability and quality of the Service, we do not guarantee uninterrupted or error-free operation.

No liability for indirect damages: we disclaim responsibility for indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of data, loss of business opportunities, or reputational harm.

Temporary interruptions: we shall not be liable for temporary interruptions due to maintenance, updates, bugs, or external technical failures.
Force majeure: our liability is excluded in case of events beyond our reasonable control, including natural disasters, cyberattacks, failures of hosting/cloud providers, or other events classified as force majeure under French law.

Maximum liability: in any case, Lancrey-Javal Technologies’ aggregate liability is strictly limited to the total fees paid by the user during the twelve (12) months preceding the claim.

8. Modification of the Terms

Lancrey-Javal Technologies reserves the right to update or modify these Terms at any time. Changes are effective upon publication on the site. Continued use of the Service after publication constitutes acceptance of the revised Terms.

9. Governing Law and Jurisdiction

These Terms are governed by French law. In case of dispute, jurisdiction is conferred upon the competent courts of Paris, France, unless otherwise required by applicable law.
